Terms of Service

By signing up for the YourOwnCart.com (hereinafter referred to as “YOC”) service you are agreeing to be bound by the following terms and conditions. Any new features or tools which are added to the current service shall also be subject to the Terms of Use. YOC reserves the right to update and change this Terms of Service without prior notice. You are advised to check the Terms of Use from time to time for any updates or changes that may impact you.

Account Terms

1. You must provide your full legal name, a valid e-mail address, and any other information needed in order to complete the sign up and account activation process.
2. You may not use the YOC service for any illegal or unauthorized purpose nor may you violate any laws.
3. You are responsible for all activity and content (data, graphics, photos, and links) that is uploaded to your account.
4. You must not transmit any worms or viruses or any code of a destructive nature.

General Conditions

1. You understand that your content (not including sensitive information such as credit card information), may be transferred unencrypted and involve (a) transmission over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
2. We may, but have no obligation to, remove content and accounts containing content that we determine are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
3. We does not warrant that the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, or that any errors in the service will be corrected.
4. Your use of our service is at your sole risk. The service is provided on an 'as is' and 'as available' basis without any warranty or condition, express, implied or statutory. We do not warrant that the service will be uninterrupted, timely, secure, error-free, or that the results that may be obtained for the use of the service will be accurate or reliable.
5. You expressly understand and agree that YOC shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service. In no event shall YOC be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement. You agree to indemnify and hold us and (as applicable) our parents, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
6. We do not claim any intellectual property rights over the material you provide to the YOC service. All material you upload remains yours. You can remove your shop at YOC at any time by contacting us to delete your account. This will also remove all content you have stored in the service.
7. You retain ownership over all content that you submit to your shop at YOC. You agree to allow others to view your content through YOC and related domains and sub-domains (including, but not limited to, Miyoc.com).
8. The failure of YOC to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. The Terms of Use constitutes the entire agreement between you and YOC and govern your use of the service, superseding any prior agreements between you and YOC (including, but not limited to, any prior versions of the Terms of Use).

Privacy

1. YOC will never sell, rent, giveaway or share personally identifiable information about you or your business to any third party (not including our related domains) without first receiving your permission, and all uses of any personally identifiable information about you and your business will be subject to our Privacy Policy.
2. Personal information (such as address and contact number) will never be disclosed to third party without receiving your permission, or any court order. These information are collected for YOC internal recording and for contact purpose if any issue arise.
3. Your email, however, will be disclosed to your customers for contact purpose.
4. All credit card payment will be handled by our designated processors and we does not store any credit card details.

Services & Subscriptions

1. All accounts set up are free, with access to all basic functions provided in YOC system.
2. You can opt for use of additional tools (as listed in Toolbox Section) on paid subscription basis. Subscription rate for each tool varies. By establishing the recurring subscription with YOC via PayPal, you agree to stated terms and subscription rate. Subscription rate remains valid throughout your subscription period.
3. You are required to use PayPal as the payment solution for all subscriptions with YOC. By following provided instructions during checkout, automated recurring billing will be establish. Your account will be automatically billed for next renewal, unless subscription is cancelled.
4. We does not warrant that the quality of any paid products, services, information, or other material purchased or obtained by you through the service will meet your expectations, or that any errors in the service will be corrected.
5. All transactions are logged and customers are charged according to agreed subscription terms.
6. Failure to make payment for new subscription term when demanded may result in termination of the subscription.
7. Subscriptions can be terminated or cancelled by writing (via email) to us. Once we receive and performed your request, we will inform you in writing (typically email) that your subscription has been terminated. Cancellation of recurring subscription at PayPal may also result in termination of the subscription of the tool at YOC. We offer no refund for any early termination or cancellation of any subscription.
8. We reserves the right at any time to time to modify or discontinue, the service (or any part thereof) without prior notice.
9. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the service.
10. Upon termination or cancellation of subscription (either by will or bounded by terms) you will no longer be able to access the tool from your account. Information saved may be lost.
11. Your use of this service is at your sole risk. Our weekly backup service overwrites any of our previous backups made, and only one week of backups are kept. This service is provided to you as a courtesy. You agree to take full responsibility for files and data of your account. You can retrieve the backup files in writing (via email) to us. Administrative fee applies.
12. All accounts on YOC are limited to use not more than 25% or more of system resources for longer then 90 seconds or 3 co-current processes. There are numerous activities that could cause such problems; these include, but not limited to, badly scripted template. Warnings may to issued during such situation, thereafter follow up by account suspension.
13. You can terminate your account by writing (via email) to us. Once we receive and performed your request, we will inform you in writing (typically email) that your account has been terminated.

Miscellaneous

1. This agreement represents the general agreement concerning this service between you and YOC.
2. Prior agreements or additional agreements acknowledged by both parties via other means may be presented by YOC.
